为什么我们选择成为新山离婚律师?离婚不是儿戏,留下也不应只是忍耐

曾经有一位亲戚好奇地问我:

“为什么你会选择成为一名离婚律师?”

很多人认为,离婚律师每天面对的是家庭破裂、感情纠葛、孩子争议和财产冲突,是一份复杂、沉重,也容易受到社会误解的工作。

我的答案其实很简单。

我希望凭借自己的经历和专业知识,帮助站在人生十字路口的人看清方向。

我不是为了鼓励别人离婚,也不是要替任何一方攻击配偶。

我真正希望做到的,是让一个人在婚姻最混乱、最无助的时候,至少能够知道:

  1. 自己有哪些选择;
  2. 每一种选择有什么后果;
  3. 孩子可能受到什么影响;
  4. 财产和债务应怎样面对;
  5. 婚姻还有没有挽回的空间;
  6. 如果真的要离开,应怎样为未来做好准备。

婚姻不是儿戏,离婚更不是

我们经常听长辈说:

“婚姻不是儿戏。”

这句话提醒我们,结婚代表承诺、责任和共同生活。

但是,我们也希望提醒大家:

离婚同样不是儿戏。

离婚不只是签署一份文件,也不只是恢复单身身份。它可能同时涉及:

  1. 孩子由谁照顾;
  2. 探视和日常生活如何安排;
  3. 孩子的教育与医疗决定;
  4. 配偶及孩子的赡养费;
  5. 房屋、车辆和其他资产;
  6. 房屋贷款及共同债务;
  7. 公司、股份和家庭生意;
  8. 搬迁与未来居住安排;
  9. 双方父母和亲友关系;
  10. 离婚后的心理与生活重建。

很多人在情绪最激动的时候,只想尽快结束眼前的痛苦,却还没有认真想过离婚后的现实生活。

律师的责任,不是乘着当事人的愤怒推动案件,而是帮助当事人把今天、明天和未来几年都看清楚。

法律程序与婚姻辅导,不是同一件事

在一些国家或地区,社会服务、心理辅导或婚姻辅导可能更普遍地介入夫妻关系,让双方在作出最终决定前先了解问题。

在马来西亚,至少需要分清两件事:

第一是婚姻辅导或心理辅导;
第二是法律上的婚姻仲裁庭或调解程序。

对于马来西亚非穆斯林婚姻,如果夫妻双方同意离婚,可以根据适用条件向法院提出共同离婚申请。

如果只有其中一方要求离婚,则可能涉及婚姻已经破裂且无法挽回的争议,以及向国民登记局婚姻仲裁庭作出转介等程序。不过,法律也规定某些情况可能申请或适用豁免。

因此,不能简单地说:

“单方面离婚一定要先接受心理辅导。”

国民登记局的婚姻仲裁庭程序具有尝试和解及处理法律程序要求的作用,但它不等同于由心理学家或专业辅导员提供的婚姻治疗。

每宗案件需要采用什么程序,应根据双方是否同意、结婚时间、婚姻状况和其他事实判断。

不是每一个婚姻问题都需要通过离婚解决

夫妻之间发生争吵,并不代表婚姻已经无法继续。

很多矛盾可能来自:

  1. 双方不懂得沟通;
  2. 工作和照顾孩子造成压力;
  3. 与双方父母相处出现问题;
  4. 金钱和债务没有透明处理;
  5. 一方长期感到被忽略;
  6. 双方对婚姻责任的理解不同;
  7. 过去的伤害从未真正解决;
  8. 彼此仍然在乎,却只会用错误方式表达。

如果双方仍然安全,也愿意面对问题,婚姻辅导、坦白沟通、财务规划或重新建立家庭界线,都可能提供帮助。

有时,当事人真正需要的不是离婚,而是一个让双方冷静下来、重新理解问题的机会。

但是,留下来也不应该只是无限忍耐

社会经常劝面对婚姻问题的人:

“为了孩子,再忍一忍。”

“夫妻都是这样的。”

“不要让别人看笑话。”

“离婚很丢脸。”

“忍久了就会习惯。”

这些话有时出于好意,却未必适合每一个家庭。

如果婚姻已经长期出现以下问题,就不应只要求其中一方继续忍耐:

  1. 肢体暴力或明确威胁;
  2. 长期言语羞辱和心理控制;
  3. 严重控制金钱和行动;
  4. 不断发生却拒绝处理的婚外关系;
  5. 隐瞒重大债务或转移资产;
  6. 利用孩子惩罚配偶;
  7. 强迫配偶签署贷款或担保文件;
  8. 长期遗弃家庭责任;
  9. 对方完全拒绝沟通和改变;
  10. 当事人与孩子的人身安全受到威胁。

保住婚姻不应以摧毁一个人的安全、尊严和生活能力为代价。

有些人没有离婚,却在婚姻中慢慢失去自己

我曾经接触过一些长期身处痛苦婚姻的人。

他们没有选择极端方式,也没有马上离开,只是一天一天忍耐。

最初,他们告诉自己:

“再等一等,对方可能会改变。”

后来,他们开始失去睡眠、信心和正常生活的动力。

有些人不再与朋友联系,不敢表达意见,也无法为自己作决定。身体与情绪状态可能逐渐受到影响。

我们不能把任何疾病或死亡简单归咎于一段婚姻,因为健康问题通常涉及许多复杂因素。

但是,长期处于恐惧、压抑和高度压力之中,绝对不应该被社会当成“婚姻正常需要付出的代价”。

如果婚姻已经严重影响您的身心状态,法律意见只能处理其中一部分。您也可能需要医生、心理专业人士、辅导员、可信任的家人或相关援助机构共同提供支持。

离婚不是失败,冲动离婚也不是勇敢

有些人把离婚视为人生失败。

另一些人则认为,只要感到不开心,马上离开就是勇敢。

这两种看法都过于简单。

真正成熟的决定,是在了解事实、后果和选择以后,对自己与孩子的未来负责。

离婚有时可能成为结束长期伤害的方法,让双方停止彼此折磨并重新规划生活。

但如果只因一次争吵、第三者的煽动或一时愤怒便作出决定,当情绪平复后,可能发现自己还没有准备好面对孩子、住房、债务和财务现实。

所以,在决定离婚以前,应先问自己:

  1. 这是一次严重争执,还是长期重复的问题?
  2. 双方是否仍能安全沟通?
  3. 对方是否愿意承认问题并真正改变?
  4. 孩子是否已经受到影响?
  5. 我留下来是因为希望,还是因为恐惧?
  6. 我是否了解双方的资产和债务?
  7. 离婚后的住房、收入和照顾安排是否可行?
  8. 我作出决定时,是冷静还是正在愤怒?
  9. 如果情况持续五年,我能否接受?
  10. 我是否已经取得独立而完整的专业意见?

为什么律师要看得比当事人更远?

当事人身处婚姻冲突中,情绪往往集中在眼前发生的事情。

律师作为第三方,需要协助客户预见后续问题。

例如:

  1. 房屋由谁继续居住?
  2. 房贷由谁偿还?
  3. 如果房屋出售,如何安排过程?
  4. 孩子的日常照顾是否可实行?
  5. 探视时间是否符合上学与工作安排?
  6. 双方收入能否承担新的生活模式?
  7. 共同债务会不会在离婚后继续存在?
  8. 公司或家庭生意是否受到影响?
  9. 双方能否遵守谈好的安排?
  10. 条款是否清楚到能够执行?

一份看起来很快完成的离婚协议,如果没有认真考虑现实生活,日后仍可能产生新的冲突。

真正好的结果,不只是“成功取得离婚令”,而是当事人在程序结束以后,仍然能够有秩序地继续生活。

共同申请离婚与单方面离婚有什么不同?

对于马来西亚非穆斯林婚姻,常见情况可概括为:

双方同意离婚

如果夫妻双方都同意结束婚姻,并能就孩子、赡养费、资产和其他事项达成安排,可以考虑共同提出离婚申请。

双方同意,并不代表什么都不需要讨论。相反,越早把条款谈清楚,越能减少日后的争议。

只有一方要求离婚

如果另一方不同意离婚,或者双方无法就重要事项达成协议,则可能涉及有争议的离婚程序。

提出申请的一方需要根据实际事实和适用法律说明婚姻为何已经破裂至无法挽回,并处理相关程序要求。

每宗案件不同,不应只根据朋友的经历或网上模板判断自己的情况。

离婚以前,先准备这些资料

咨询新山离婚律师时,可以准备:

  1. 结婚证书;
  2. 双方身份证明;
  3. 孩子的出生证明;
  4. 双方收入资料;
  5. 银行及信用卡记录;
  6. 房屋、车辆和贷款文件;
  7. 公司、股份和投资资料;
  8. 保险、公积金及其他财务资料;
  9. 与孩子照顾有关的记录;
  10. 与重大争议有关的完整信息;
  11. 按日期排列的重要事件时间线;
  12. 双方曾经作出的书面安排。

请不要修改、伪造或故意删除资料,也不要通过破解密码、冒用账号或其他不合法方式取得证据。

律师越早知道完整事实,就越能准确评估风险。

不要为了赢官司,把孩子变成输家

离婚中最无辜、也最容易受到影响的,往往是孩子。

父母不应:

  1. 要求孩子选择爸爸或妈妈;
  2. 在孩子面前侮辱另一方;
  3. 把孩子当作传话工具;
  4. 利用探视安排报复配偶;
  5. 要求孩子监视另一方;
  6. 把成年人的婚外情或财务细节告诉年幼孩子;
  7. 以停止见孩子作为谈判武器。

婚姻关系可能结束,但父母对孩子的责任不会因此消失。

双方未必还能成为夫妻,却仍然需要学习怎样继续作为父母合作。

为什么我选择成为新山离婚律师?

我选择这份工作,不是因为我喜欢看见婚姻结束。

相反,我尊重婚姻,也知道建立一个家庭需要很多时间、牺牲和承诺。

正因为如此,当婚姻出现危机时,更不能只靠冲动处理。

有些婚姻仍有挽回空间,我们不应急着推倒;有些关系已经长期造成伤害,我们也不应只用道德压力要求当事人继续承受。

  4. 什么可以协商;
  5. 什么需要保护;

Why Did We Choose to Become Divorce Lawyers in Johor Bahru? Divorce Is Not a Trivial Matter, but Staying Should Not Mean Enduring Without Limit

A relative once asked me:

“Why did you choose to become a divorce lawyer?”

Many people regard divorce law as a complicated and emotionally demanding area involving family breakdowns, relationship disputes, children and property. It is also a profession that can easily be misunderstood by society.

My answer is simple.

I hope to use my experience and professional knowledge to help people standing at a crossroads in life understand the directions available to them.

I do not encourage people to divorce, nor is my role to help one spouse attack the other.

What I genuinely hope to achieve is to ensure that, during the most confusing and helpless period of a marriage, a person can at least understand:

  1. The available options;
  2. The consequences of each option;
  3. How the children may be affected;
  4. How the assets and debts should be addressed;
  5. Whether the marriage may still be saved; and
  6. How to prepare for the future if leaving becomes necessary.

Marriage Is Not a Trivial Matter—and Neither Is Divorce

We often hear older generations say:

“Marriage is not a trivial matter.”

This reminds us that marriage involves commitment, responsibility and building a life together.

However, we also wish to remind everyone that:

Divorce is not a trivial matter either.

Divorce involves more than signing a document or becoming legally single again. It may simultaneously involve:

  1. Who will care for the children;
  2. Access arrangements and the children’s daily routines;
  3. Decisions concerning the children’s education and medical care;
  4. Maintenance for the spouse and children;
  5. The house, vehicles and other assets;
  6. Housing loans and joint debts;
  7. Companies, shares and family businesses;
  8. Relocation and future living arrangements;
  9. Relationships with both families and mutual friends; and
  10. Emotional recovery and rebuilding life after divorce.

During moments of intense emotion, many people want only to end their immediate pain without seriously considering the practical realities of life after divorce.

A lawyer’s responsibility is not to use the client’s anger to push the case forward. It is to help the client understand the consequences today, tomorrow and several years into the future.

Legal Procedures and Marriage Counselling Are Not the Same

In some countries or regions, social services, psychological counselling or marriage counselling may play a more prominent role in marital difficulties, allowing spouses to understand their problems before making a final decision.

In Malaysia, two matters should be distinguished:

  1. Marriage or psychological counselling; and
  2. The legal conciliatory body or mediation process.

For a Malaysian non-Muslim marriage, where both spouses agree to divorce, they may, subject to the applicable requirements, jointly petition the court.

Where only one spouse wishes to divorce, the matter may involve establishing that the marriage has irretrievably broken down and complying with the relevant referral requirements involving the Marriage Tribunal at the National Registration Department. However, exemptions may be available or applicable in certain circumstances.

It is therefore inaccurate to state generally that:

“A person seeking a unilateral divorce must first undergo psychological counselling.”

The Marriage Tribunal process conducted through the National Registration Department aims to attempt reconciliation and satisfy the relevant procedural requirements. It is not the same as marriage therapy provided by a psychologist or professional counsellor.

The appropriate procedure will depend on whether both spouses agree, the duration and status of the marriage and the other relevant circumstances.

Not Every Marital Problem Must Be Resolved Through Divorce

An argument between spouses does not necessarily mean that the marriage can no longer continue.

Many marital conflicts may arise because:

  1. The spouses do not know how to communicate effectively;
  2. Work and childcare create significant pressure;
  3. Difficulties arise in relationships with the respective parents;
  4. Money and debts are not handled transparently;
  5. One spouse has felt ignored for a prolonged period;
  6. The spouses have different understandings of marital responsibilities;
  7. Past injuries were never genuinely addressed; or
  8. Both spouses still care but express themselves in harmful ways.

If both spouses remain safe and are willing to face the problems, marriage counselling, honest communication, financial planning or rebuilding appropriate family boundaries may help.

Sometimes, what a person truly needs is not an immediate divorce but an opportunity for both spouses to calm down and understand the underlying problems again.

However, Staying Should Not Mean Enduring Without Limit

Society often advises those facing marital difficulties:

“For the children’s sake, endure it a little longer.”

“Every marriage is like this.”

“Do not let others laugh at you.”

“Divorce is shameful.”

“You will become accustomed to it if you tolerate it long enough.”

These statements may be well-intentioned, but they are not suitable for every family.

Where a marriage has involved the following problems over a prolonged period, one spouse should not simply be told to continue enduring them:

  1. Physical violence or clear threats;
  2. Prolonged verbal humiliation and psychological control;
  3. Severe control over money and personal movements;
  4. Repeated extramarital relationships that the spouse refuses to address;
  5. Concealment of substantial debts or transfers of assets;
  6. Using the children to punish the spouse;
  7. Forcing the spouse to sign loan or guarantee documents;
  8. Prolonged abandonment of family responsibilities;
  9. A complete refusal to communicate or change; or
  10. Threats to the personal safety of the spouse or children.

Preserving a marriage should not require a person to sacrifice their safety, dignity and ability to function.

Some People Remain Married but Gradually Lose Themselves

I have encountered people who remained in deeply unhappy marriages for many years.

They did not take extreme action or immediately leave. They simply endured the situation one day at a time.

At first, they told themselves:

“I will wait a little longer. Perhaps my spouse will change.”

Over time, they began losing sleep, confidence and motivation to continue with ordinary life.

Some stopped contacting friends, became afraid to express their views and could no longer make decisions for themselves. Their physical and emotional well-being gradually suffered.

No illness or death should be attributed solely to a marriage because health problems usually involve many complex factors.

However, living under prolonged fear, suppression and intense stress should never be treated by society as a “normal price” that a person must pay for marriage.

If your marriage has seriously affected your physical or emotional condition, legal advice can address only part of the problem. You may also require support from a doctor, mental-health professional, counsellor, trusted family member or appropriate support organisation.

Divorce Is Not Failure, but an Impulsive Divorce Is Not Courage

Some people regard divorce as a failure in life.

Others believe that leaving immediately whenever they feel unhappy is an act of courage.

Both views are overly simplistic.

A mature decision is one made after understanding the facts, consequences and available options and accepting responsibility for your own and your children’s future.

Divorce may sometimes provide a way to end prolonged harm, stop the spouses from continuing to hurt one another and allow both parties to rebuild their lives.

However, where the decision follows a single argument, pressure from a third party or temporary anger, the person may later discover that they were unprepared to face the realities involving the children, housing, debts and finances.

Before deciding to divorce, ask yourself:

  1. Is this a single serious disagreement or a long-standing and repeated problem?
  2. Can both spouses still communicate safely?
  3. Is the other spouse willing to acknowledge the problem and make genuine changes?
  4. Have the children already been affected?
  5. Am I staying because of hope or fear?
  6. Do I understand the assets and debts of both parties?
  7. Are the post-divorce housing, income and caregiving arrangements practical?
  8. Am I making this decision calmly or while angry?
  9. If the circumstances remain unchanged for another five years, can I accept them?
  10. Have I obtained independent and complete professional advice?

Why Must a Lawyer Look Further Ahead Than the Client?

A person experiencing marital conflict will naturally focus on what is happening immediately.

As an independent adviser, the lawyer should help the client anticipate what may happen next.

For example:

  1. Who will continue occupying the family home?
  2. Who will service the housing loan?
  3. How should the process be arranged if the property is sold?
  4. Are the proposed childcare arrangements practical?
  5. Do the proposed access arrangements accommodate school and work schedules?
  6. Can both parties afford their new living arrangements?
  7. Will joint debts continue after the divorce?
  8. Will a company or family business be affected?
  9. Can both parties realistically comply with the agreed arrangements?
  10. Are the terms sufficiently clear to be enforced?

A divorce agreement that is completed quickly without considering everyday realities may still create new disputes later.

A genuinely good outcome involves more than successfully obtaining a divorce order. The parties should also be able to continue their lives in an orderly manner after the proceedings have concluded.

What Is the Difference Between a Joint Petition and a Single Petition for Divorce?

For a Malaysian non-Muslim marriage, the common situations may be summarised as follows.

Where Both Spouses Agree to Divorce

If both spouses agree to end the marriage and can reach an arrangement concerning the children, maintenance, assets and other matters, they may consider filing a joint petition for divorce.

Mutual agreement does not mean that nothing needs to be discussed. On the contrary, addressing the terms clearly at an early stage may reduce future disputes.

Where Only One Spouse Wants a Divorce

If the other spouse does not agree to divorce, or if the parties cannot agree on important matters, contested divorce proceedings may be required.

The petitioning spouse must rely on the actual facts and applicable law to explain why the marriage has irretrievably broken down and comply with the relevant procedural requirements.

Every case is different. A person should not assess their position solely by relying on a friend’s experience or an online template.

Documents to Prepare Before Consulting a Divorce Lawyer

When consulting a Johor Bahru divorce lawyer, consider preparing:

  1. The marriage certificate;
  2. Identification documents for both spouses;
  3. The children’s birth certificates;
  4. Income information for both parties;
  5. Bank and credit-card records;
  6. Property, vehicle and financing documents;
  7. Company, shareholding and investment records;
  8. Insurance, EPF and other financial information;
  9. Records concerning the care of the children;
  10. Complete information relating to significant disputes;
  11. A chronological timeline of important events; and
  12. Written arrangements previously made by the parties.

Do not alter, fabricate or deliberately delete information. You should also not obtain evidence through password hacking, account impersonation or other unlawful means.

The earlier your lawyer receives the complete facts, the more accurately the risks can be assessed.

Do Not Turn the Children into the Losers of the Divorce

The children are often the most innocent and vulnerable people affected by divorce.

Parents should not:

  1. Force a child to choose between the father and mother;
  2. Insult the other parent in front of the child;
  3. Use the child as a messenger;
  4. Use access arrangements to punish the other parent;
  5. Ask the child to monitor the other parent;
  6. Disclose adult details about infidelity or finances to a young child; or
  7. Use the suspension of contact with the child as a negotiating weapon.

The marital relationship may end, but the parents’ responsibilities towards the children do not.

The parties may no longer be able to remain husband and wife, but they must still learn how to cooperate as parents.

Why Did I Choose to Become a Divorce Lawyer in Johor Bahru?

I did not choose this profession because I enjoy seeing marriages end.

On the contrary, I respect marriage and understand that building a family requires considerable time, sacrifice and commitment.

For this reason, a marital crisis should not be handled impulsively.

Some marriages may still be repaired and should not be hastily dismantled. Other relationships may have caused prolonged harm, and the affected person should not be required to continue suffering merely because of social or moral pressure.

A divorce lawyer’s true role is to help the client distinguish, during a confusing period:

  1. Emotion from fact;
  2. Facts from legal responsibilities;
  3. What may be negotiated;
  4. What needs to be protected; and
  5. Which decisions may affect the future.

A lawyer cannot live the client’s life or guarantee that the client will be happy after divorce.

However, a lawyer can help the client avoid unnecessary mistakes and make an informed decision after understanding the consequences.

No. You may first understand your rights, responsibilities and risks before deciding whether to pursue counselling, negotiation, separation or divorce proceedings.

2. If Both Spouses Agree to Divorce, Must They Still Go to Court?

Yes. For a valid Malaysian non-Muslim marriage, the parties must still comply with the applicable law and court procedures even if they both agree to divorce.

3. Must a Person Seeking a Single Petition for Divorce First Undergo Psychological Counselling?

It cannot be stated so generally.

A contested divorce may involve a referral to the Marriage Tribunal at the National Registration Department. However, that process is not the same as professional psychological counselling, and an exemption may be available in certain circumstances.

The appropriate procedure must be determined based on the individual facts.

4. Can a Couple Divorce if They Have Been Married for Less Than Two Years?

Generally, a petition for divorce involving a non-Muslim marriage is subject to the requirement that the marriage must have continued for at least two years.

Where exceptional circumstances or hardship exist, an application for the court’s permission may be required. Whether this applies must be assessed based on the specific facts.

5. Does a Divorce Involve Only the Children and the Matrimonial Home?

Not necessarily. It may also involve maintenance, vehicles, companies, shares, joint debts, insurance, investments, living arrangements and other responsibilities.

6. If My Spouse Does Not Agree, Does That Mean I Can Never Get Divorced?

Not necessarily. Whether a contested divorce petition may be filed and which procedures must be completed will depend on the facts of the marriage and the applicable law.

7. Will the Mother Automatically Obtain Custody After Divorce?

Not automatically.

For a child below seven years of age, the law generally recognises a rebuttable presumption that it is in the child’s best interests to be with the mother. However, the child’s welfare remains the paramount consideration, and the court will also consider the actual caregiving arrangements and all relevant circumstances.

The final order will depend on the facts of the individual case.
